PRODUCT SAFETY, ASSUMPTION OF RISK & LIABILITY
1. Nature of products. ShutterBombs, Inc. sells colored smoke devices (smoke grenades/bombs) and related pyrotechnic-class products. These products
generate heat, fire, and dense smoke, and are inherently dangerous if misused. They are sold for lawful, recreational, photographic, and
professional use only.
2. Age requirement. You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to purchase or use our
products. By purchasing, you represent that you meet this requirement.
3. Assumption of risk. You knowingly and voluntarily assume all risks associated with the purchase, possession, handling, storage, transport, and
use of our products, including but not limited to risk of fire, burns, smoke inhalation, property damage, personal injury, or death. You accept full
and sole responsibility for the safe and lawful use of any product purchased.
4. Safe use & instructions. You agree to read, understand, and strictly follow all product instructions, warnings, and safety guidelines, and to use
products only outdoors, in a safe environment, away from people, animals, structures, dry vegetation, and flammable materials, and never in
violation of any fire ordinance or burn ban.
5. Compliance with laws. Colored smoke devices are regulated and may be restricted or prohibited in certain states, counties, municipalities, parks,
venues, or properties. You are solely responsible for determining and complying with all applicable federal, state, and local laws, regulations,
ordinances, and venue rules before purchasing or using our products. We make no representation that any product is legal for use in your location.
6. Release & waiver of liability. To the fullest extent permitted by law, you release, waive, and discharge ShutterBombs, Inc., its officers,
directors, employees, agents, suppliers, and affiliates from any and all liability, claims, demands, damages, costs, or expenses of any kind arising
out of or related to your purchase, possession, or use (or misuse) of our products, whether caused by negligence or otherwise.
7. No warranty beyond stated guarantee. Except for the limited product guarantee set out in our Refund Policy, all products are provided "as is"
without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose, to the fullest extent permitted
by law. In no event shall our total liability exceed the purchase price of the product giving rise to the claim.
8. Indemnification. You agree to indemnify, defend, and hold harmless ShutterBombs, Inc. and its officers, directors, employees, agents, and
affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from
your purchase, use, or misuse of our products, your violation of any law, or your breach of these terms.
9. Third-party conduct. ShutterBombs, Inc. is not responsible for the actions of any purchaser or third party who uses our products in an unlawful,
negligent, or unintended manner. Responsibility for safe and lawful use rests solely with the end user.
